<h1>Definitions</h1> <ul> <li><strong>Agricultural Easement Area</strong>: An area designated for agricultural purposes, such as farming and ranching. This area is identified as "Agricultural Easement Area" on any recorded plat or the Melody Ranch Planned Unit Development Plan and is subject to certain restrictions and limitations.</li> <li><strong>ARC</strong>: Architectural Review Committee.</li> <li><strong>Benefiting Parcel</strong>: The property comprising all of the parcels reflected in Melody Ranch Upper Ranch Master Plat along with the Second and Third Amendments thereof, excluding specific lots.</li> <li><strong>Declarant</strong>: Melody Ranch Development I LLC, a Wyoming limited liability company.</li> <li><strong>Declaration</strong>: The Declaration of Protective Covenants for Melody Ranch Residential Unit Two - Second Filing and any amendments, supplements, or additions recorded in the office of the Clerk and Recorder of Teton County, Wyoming, including any associated maps or plats.</li> <li><strong>Improvement and Service District</strong>: A quasi-government entity, if any, formed and approved for the Melody Ranch Subdivision to provide certain services and improvements within the Melody Ranch Planned Unit Development and surrounding properties.</li> <li><strong>Lots</strong>: All of the subdivision lots shown on a recorded plat of the Subdivision and designated by a lot number.</li> <li><strong>Melody Ranch Planned Unit Development Final Development Plan</strong>: The Final Development Plan for the Melody Ranch Planned Unit Development approved by the Board of County Commissioners of Teton County, Wyoming, on October 3, 1995, and amended from time to time.</li> <li><strong>Melody Ranch Residential Unit Two</strong>: Specific lots of the Melody Ranch Upper Ranch Master Plat Third Amendment according to a plat recorded as Plat No. 950 in the records of the Teton County Clerk, Teton County, Wyoming on April 20, 1999.</li> <li><strong>Owner</strong>: Any person or entity, including the Declarant, who owns one or more lots of the Subdivision. The term "Owner" does not refer to any lien holder unless such lien holder has acquired title pursuant to foreclosure or any proceeding in lieu of foreclosure.</li> <li><strong>Recorded Plat</strong>: The subdivision plat described as Melody Ranch Residential Unit Two - Second Filing to be recorded in the records of the Teton County Clerk, Teton County, Wyoming (referred to as "Plat") and any Amendments or Replats thereof of all or a portion of said Lands.</li> <li><strong>Recreational Open Space Lot</strong>: Lots identified on the Plat as "Recreational Open Space" and subject to certain restrictions and limitations.</li> <li><strong>Subdivision and the Term Subdivide</strong>: The term "Subdivision" refers to Melody Ranch Residential Unit Two - Second Filing, according to the Declaration of Protective Covenants for Melody Ranch Residential Unit Two - Second Filing and the Plat thereof, filed for record in the real property records of Teton County, Wyoming. The terms "subdivide" or "subdivided" apply to the creation of a separate lot or lots processed as a subdivision under the terms of Teton County Land Development Regulations.</li> </ul>
